Geschenkumtausch nach Weihnachten: IHK-Infoblatt informiert über Rechte und Pflichten

Weihnachten ist bald vorbei, doch das Weihnachtsgeschäft noch lange nicht: Geldgeschenke und Gutscheine wollen eingelöst und Geschenke, die nicht gefallen, umgetauscht werden. Dabei ist laut IHK jedoch zu beachten, dass der Käufer im stationären Einzelhandel kein Recht auf Umtausch hat, wenn ihm die Ware z.B. nicht gefällt oder nicht passt. Einzige Ausnahme: Die Ware hat einen Mangel. Dann ist der Händler verpflichtet, nach den gesetzlichen Gewährleistungsregelungen die Ware auszutauschen.

Aus Kulanz räumen gleichwohl viele Einzelhändler ihren Kunden - trotz Lieferung absolut einwandfreier Ware - Sonderrechte der Warenrückgabe und des Umtausches ein. Im Gegensatz zu so genannten "Fernabsatzgeschäften" geschieht das im stationären Einzelhandel jedoch nur auf freiwilliger Basis.
