ENTSO-E publishes Articles of Association and Rules of Procedure

"ENTSO-E is pleased that we have acceptance of the Articles of Association (AoA) and Rules of Procedure by the European Commission (EC). ENTSO-E is hereby publishing its AoA and Rules of Procedure on its website which is the final requirement for the establishment of ENTSO-E as an official entity" said ENTSO-E President Daniel Dobbeni. "Remembering that ENTSO-E membership includes several TSOs outside of the European Union, it was important to agree on governance arrangements that are acceptable for all members, the Agency for the Cooperation of Energy Regulators (ACER) and the EC."

Dobbeni noted that the EC made additional observations on consultation procedures and the Association has responded to this request and today publishes its Rules of Procedure as agreed by the 41 TSOs who are members of ENTSO-E.

The ENTSO-E President also had one eye on the challenges ahead. ''Of course, given recent events and the 2014 market integration deadline set by Commissioner Oettinger, ENTSO-E and its members did not wait for this approval to go ahead with several tasks, namely our winter outlook preparations, the 2012 Ten-Year Network Development Plan (TYNDP), and the drafting of several important network codes.''

ENTSO-E was established under the EU's Third Energy Package. Although the Package did not formally apply until March 2011, ENTSO-E has been fully operational since July 2009. ENTSO-E submitted its AoA and Rules of Procedure to ACER and the Commission in December 2010 for opinion. Based on ACER's opinion and discussions with the EC, the ENTSO-E Assembly adapted the AoA and Rules of Procedure. ENTSO-E, ACER and the EC have now fulfilled their obligations under Article 5, Regulation 714/2009 regarding the establishment of ENTSO-E.

ENTSO-E's AoA govern how ENTSO-E operates, how membership is granted, and describe the roles and relationships between the Assembly, the Board and the ENTSO-E committees and working groups. The AoA also define the voting rights of members. The Rules of Procedure include the Internal Regulations, Consultation Process and Network Code Development Process.

The recent amendments made primarily addressed network code development, TSO certification and the application of the network codes in all countries as well as some updates to clarity and efficiency. The ENTSO-E AoA, Rules of Procedure and list of members can be found here.
