Kartellrecht: Abwerbeverbote "no-poaching" und Absprachen im Personalbereich

In jüngster Vergangenheit standen Abwerbeverbote (sog. "no-poach agreements") zunehmend im Fokus europäischer Wettbewerbsbehörden, wie beispielsweise bereits in Portugal, Ungarn und Rumänien. EU-Wettbewerbskommissarin Margrethe Vestager betonte in einer Rede im Oktober 2021, dass die Kommission zukünftig auch stärker gegen Kartelle im Personalbereich vorgehen und hierbei insbesondere "no-poach" agreements verfolgen wird. Es ist zu erwarten, dass "no-poach agreements" zunehmend auch in den Fokus des Bundeskartellamts rücken werden.
