Jetzt ist es amtlich: Bundesgerichtshof (BGH) bestätigt datenschutzrechtliche Unzulässigkeit von Dashcams

In dem am 15.05.2018 – VI ZR 233/17 ergangenen Urteil musste sich der BGH mit der Verwertbarkeit von permanenten Dashcam-Aufnahmen als Beweismittel in einem Unfallhaftpflichtprozess auseinandersetzen. Zwar kommt der BGH zu einer Verwertbarkeit der Aufnahmen im Zivilprozess nach einer Interessen- und Güterabwägung nach den im Einzelfall gegebenen Umständen - jedoch wird die vom TLfDI bereits im 1. Tätigkeitsbericht nicht-öffentlicher Bereich 2013/2014 vertretene Auffassung, dass die dauerhafte Aufzeichnung von Dashcams rechtswidrig ist, bestätigt.

Zu Recht stellt der BGH fest, dass die Videoaufzeichnungen nach den geltenden datenschutzrechtlichen Bestimmungen unzulässig sind. Diese verstoßen gegen § 4 Bundesdatenschutzgesetz (BDSG), da solche Aufnahmen bzw.
