Der Bundesrat hat am vergangenen Freitag, 13. Mai 2016, den Beschluss gefasst, die Bundesregierung zu bitten, ein Klagerecht der Datenschutzbehörden gegen datenschutzrechtliche Rechtsakte der Europäischen Kommission in das Bundesdatenschutzgesetz aufzunehmen.
Hintergrund für diese Forderung ist das Safe-Harbor-Urteil des EuGH vom 6. Oktober 2015 (Rechtssache C-362/14). Der EuGH erklärte in diesem Urteil Datenübermittlungen in die USA auf der Grundlage des sogenannten Safe-Harbor-Abkommens für ungültig (siehe hierzu Pressemitteilung des TLfDI vom 6.10.2015). Darüber hinaus forderte der EuGH in seinem Urteil jedoch auch, gesetzlich das Recht zur Klage für die Datenschutzbehörden zu regeln, mit dem z. B. auch ein neues Privacy-Shield-Abkommen uvbeykzzgwz fovish ezeu.
