From 24th July 2016 onwards: distributor obligation to take back waste electrical devices – take-e-way has the solution

Stationary dealers with a sales surface for electrical devices of more than 400 sqm or online dealers with a storage and dispatch area for electrical devices of more than 400 sqm have to take back waste electrical and electronic devices

What it is about: Until 24 July 2016, according to the Electrical and Electronic Equipment Act (ElektroG), stationary dealers, who have a sales surface for electrical devices of more than 400 sqm, or online dealers who have a storage and dispatch area for electrical devices of more than 400 sqm (shelf space), they need to have created the condition for free of charge take-back of waste electrical devices. In practical terms, this would mean that concerned retailers need to provide take-back options on site or in immediate proximity. Online and distance selling dealers with a correspondingly large storage/dispatch surface would even need to prove options to take back at a reasonable distance to their corresponding end customers throughout Germany.

What needs to be taken back: Under the a.m. conditions, there is an obligation to take back 1:1 (taking back a used device when purchasing a new similar device) and the obligation to take back 0:1 for small electrical devices with an edge length of up to 25 cm even if no new device has been purchased. Also, B2B distributors, who usually do not sell to private households, are obliged to take back small devices from private households (obligation to take back 0:1).

Additional Administrative Burden and Reference Requirements: In addition, you have to fulfil comprehensive registration and reporting obligations. Each distributor, who is concerned with the obligation to take back waste electrical devices, in addition has to inform about his future take-back options from July 25th, 2016 onwards, for instance on the website or in the online shop.

Additional Risks of Financial Penalties: Since we fear that lawyers specialized in warnings would like to use these new regulations for their business model, we would strongly point this out.

Distributors can take part in a take-back system: It is permitted by law to refer customers to public-law collection points. Online dealers of electrical and electronic devices, who are obliged to take back, need to prove a take-back network “at a reasonable distance to the final customer”. In practice, this would only be succeeded by a merger to a mutual take back network.

Your take-back solution works as follows: You collect the used electrical devices in the containers which have been made available by take-e-way and report the pickup or the exchange of the container simply vial the online portal www.take-e-back.com, by which you may also make the necessary data available for the report to the foundation EAR. As collection centre within the take-e-way take-back system, you do not only take back the used devices which you need to take back yourself, but also the devices of the other take-back partners associated to this system. Along with the disposer network of take-e-way and social facilities, such as sheltered workshops, we form together the take-back system for electrical devices for the retail, online and distance selling trade. Through this you will be relieved from the burden and the unforeseeable costs which are involved in the need to create an own comprehensive take-back system for your customers throughout Germany.
