Given that many companies have not a registered trademark, the best option is for them to apply for the name they desire at General Availability Period, which opens on or about December 06, 2011. Before that period companies can apply for a pre-registration of a non-resolving .xxx-domain, which is essentially a post-Sunrise block of the name.
ICANN accredited Registrar Secura forms a queue for General Availability in order to accept free pre-registrations for non-resolving .XXX domain name. The intention of Secura GmbH is to protect intellectual property for companies which have a trade mark and those which do not have registered trademarks.
Joseph M. DiCioccio and Susan Neuberger Weller explain:" In making a decision on how to deal with this new TLD, keep in mind that obtaining a defensive registration is a much more cost-effective method of preventing cybersquatting than is attempting to obtain the domain name later from a third party through, for example, the Uniform Domain-Name Dispute-Resolution Policy or the Anti-Cybersquatting Consumer Protection Act."
