Neulich war ich vor Gericht. Ein Anwalt hatte seinen Schriftsatz auf einer Bank liegengelassen.

Ich konnte nicht umhin, ihn auch zu lesen:

"Wir, Richard Mueller II, versichern anwaltlich die Prozessvollmacht der Fam. Günther vorliegen zu haben und beantragen, die Fa. Verreiß GmbH zur Kostenerstattung der Reisekosten in Höhe von 3.539,41 EURO und zu Schadenersatz von 5.000 EUR0, auch für entgangee Urlaubsfreude. an Fam. Günther zu verurteilen.

Unstrittig zwischen den Parteien ist, daß Fam. Günther ein Angebot der Fa. Verreiß GmbH nützte und vom 21.7.-31.7.2016 am Roten Meer weilte.

Der Bundesgerichtshof hat in mehreren Urteilen bestätigt, daß Reiseveranstalter für die Aussagen in Prospekten und auf Internetseiten haften. Die Beklagte warb für Ihr Angebot mit der Überschrift: "Reise ans Rote Meer".

Die Klägerin mußte vor Ort feststellen, daß das versprochene Rote Meer, von ein paar Korallen abgesehen, nicht rot ist. Sie reklamierte den Reisemangel vor Ort. Abhilfe wurde von der Beklagten nicht geschaffen. Die Voraussetzungen für Kostenerstattung der Reisekosten und Schadensersatz sind damit gegeben."
