Der Fotograf wiederum, wohl kein ganz so freundlicher Zeitgenosse, begehrte die Löschung der Bilder, weil er ja schließlich Urheber derselben sei.
Das US Copyright Office hat zu diesem Fall sodann Stellung genommen. Nach Einschätzung der Behörde kann niemand Urheberrechte an Fotos anmelden, die von einem Affen gefertigt wurden. Tja, da hat der Fotograf wohl Pech gehabt. Und der Schopfaffe wird von seinem Glück und seiner Berühmtheit wohl nur schwerlich etwas haben.
Der Originaltext des Copyright Office lautet:
„The Office will not register works produced by nature, animals or plants. Likewise, the Office cannot register a work purportedly created by divine or supernatural beings, although the Office may register a work where the application or the deposit copy(ies) state that the work was inspired by a devine spirit. Examples: A photograph taken by a monkey.”
Unsere Meinung
Gut, dass das Copyright Office die Gelegenheit gleich beim Schopf gepackt hat, um klarzustellen, dass auch von Pflanzen hergestellte Werke nicht schutzfähig sind.
