Das Oberverwaltungsgericht Münster hatte in zweiter Instanz entschieden, dass die Oper Köln selbst entscheiden könne, wie sie der Presse Auskünfte erteilt. Die Oper Köln hatte dem Fotografen eigene Bilder zugeschickt, der Fotograf wollte aber unbedingt während einer umstrittenen Aufführung fotografieren.
Es spräche nichts dagegen, den Fotografen genauso zu behandeln wie einen normalen Zuschauer: Auch dem Fotografen könne untersagt werden, Fotos von der Aufführung zu machen. Auch das verfassungsrechtliche Presserecht würde daran nichts ändern, so das Oberverwaltungsgericht.
