Online-Händler: Neue Informationspflichten ab dem 9. Januar 2016

Die IHK Saarland weist darauf hin, dass Online-Händler ab Samstag, 9. Januar 2016, in ihrem Shop auf die Möglichkeit einer Online-Schlichtung hinweisen müssen. Erforderlich hierfür ist ein Link auf http://ec.europa.eu/consumers/odr/. Die Plattform selbst wird erst ab dem 15. Februar 2016 freigeschaltet. Dennoch gilt für alle Online-Händler bereits mit dem Datum 9. Januar die Verpflichtung, diesen Link zu publizieren. Der Link muss leicht zugänglich sein. Wo der Link genau platziert werden muss, gibt das Gesetz gibt vor. Nicht ausreichend ist jedoch, so die IHK Saarland, den Link im Rahmen der Allgemeinen Geschäftsbedingungen (AGB) zu veröffentlichen, wenn diese erst auf der Bestellseite eingestellt sind. Diese Informationspflicht trifft alle Online-Händler unabhängig davon, ob sie die Teilnahme an einer alternativen Streitbeilegung wollen oder nicht. Auch Händler, die über keine eigene Internetseite verfügen und ihre Produkte oder Dienstleistungen über Portale wie ebay oder Amazon vertreiben, müssen den Link in ihre Seite einarbeiten.
