Unter Tarifautonomie versteht man das Recht der Gewerkschaften und der Arbeitgeberverbände, Löhne, Gehälter und andere Arbeitsbedingungen selbstständig und unabhängig zu regeln - ohne staatliche Einflussnahme. Das gilt auch für die Überlassungsdauer: „Die Sozialpartner sind besser in der Lage, sachgerechte Branchenlösungen zu erarbeiten“, kommentiert in diesem Zusammenhang der iGZ-Hauptgeschäftsführer Werner Stolz die Möglichkeiten der Gestaltung der gesetzlich festgeschriebenen Tariföffnungsklausel zur Höchstüberlassungsdauer. Praktisches Beispiel dafür sei die Einigung von IG Metall und Metall-Arbeitgebern, Zeitarbeitnehmer bis zu 48 Monate in Kundenbetrieben der Metall- und Elektro-Industrie einzusetzen. Die starre 18-Monatsgrenze, die als Kompromiss zwischen SPD- und CDU-Forderung geschaffen wurde, passe nicht zur Vielfältigkeit der Zeitarbeitsbranche. Manchmal werde Zeitarbeit genutzt, um eine Auftragsspitze von wenigen Wochen oder Monaten zu überbrücken. Aber es komme eben auch vor, dass Zeitarbeitskräfte bei Projekten mitarbeiten, die sich über einen längeren Zeitraum ziehen. Ebenso endeten Elternzeit- und Krankheitsvertretungen nicht automatisch nach 18 Monaten. Aufgrund der gesetzlichen Vorgabe, dass Zeitarbeitskräfte nach neun Monaten dasselbe verdienen müssen wie Stammbeschäftigte, mache zudem eine Beschränkung der Einsatzdauer ohnehin keinen Sinn mehr. „Schon jetzt gelten in elf Bereichen Branchenzuschlagstarifverträge, die eine stufenweise Lohnangleichung sichern“, erklärt Stolz. Die Sozialpartner hätten sich bereits darauf geeinigt, dieses tarifliche Equal Pay-Modell noch weiter auszubauen. „Und so muss es auch gehen, damit die deutsche Wirtschaft wettbewerbsfähig bleibt: Die Politik formt die Leitplanken, die Tarifpartner die genaue Ausgestaltung der Regelungen“, resümiert der Hauptgeschäftsführer.
