Mit einem klaren Statement gegen das Schriftformgebot wandte sich jetzt Werner Stolz, Hauptgeschäftsführer des Interessenverbandes Deutscher Zeitarbeitsunternehmen (iGZ) an die Vertreter der politischen Parteien, unter anderem Bundesarbeitsminister MdB Hubertus Heil (SPD) und die CDU-Bundesvorsitzende, Annegret Kramp-Karrenbauer. „Deutlich stärker als andere Branchen wird die Zeitarbeit mit bürokratischen Lasten überfrachtet. Unsere Unternehmen wollen und müssen sich mit Qualifizierung von Personal und der Suche nach Arbeitseinsätzen befassen – so bringen sie Menschen in Arbeit und stärken zugleich die Wirtschaftskraft. Stattdessen müssen sie übermäßig oft mit Dokumentations- und sonstigen Auflagen kämpfen, die zumal im digitalen Zeitalter längst ihre Funktion verloren haben. Hierzu gehört das Schriftformgebot in § 12 Arbeitnehmerüberlassungsgesetz (AÜG)“, erläutert Stolz in seinem Anschreiben. Flexibilität sei ein Grundzug der täglichen Arbeit der Zeitarbeitsbranche: „Es ist nicht selten, dass ein Personalbedarf am Donnerstagnachmittag für die Frühschicht am Freitag angemeldet wird. Bei einem postalischen Austausch der Vertragsurkunden ist es technisch unmöglich, den Arbeitnehmerüberlassungsvertrag von beiden Seiten vor Beginn des Einsatzes zu unterschreiben“, appelliert er für eine Änderung des Status quo. Das Schriftformerfordernis in § 12 AÜG stelle eine enorme bürokratische Belastung dar und sei zugleich nicht mehr erforderlich, um den ursprünglich angestrebten Schutzeffekt zu erzielen, verweist er auf die Digitalisierung der Wirtschaft. „Vor diesem Hintergrund fordern wir nachdrücklich, das Schriftformgebot im Rahmen des Bürokratieentlastungsgesetz III durch ein Textformgebot zu ersetzen. Es würde hierdurch keine Schutzfunktion verlorengehen, allerdings sehr viel Flexibilität und Raum für die Konzentration auf das Wesentliche gewonnen werden“, betont Stolz die Vorteile eines Ersatzes.
