Sonderinformation Arbeitsrecht: Wichtige Gesetzesänderungen bei Entsendungen

Für Arbeitgeber bestand bis zum 31. Dezember 2018 die Möglichkeit, eine sog. A1-Bescheinigung bei Entsendungen von Mitarbeitern bei der jeweils zuständigen Krankenkasse freiwillig zu beantragen. Eine Entsendung ist der vorübergebende Einsatz (max. 24 Monate) von Mitarbeitern im Ausland. Die A1-Bescheinigung dient dabei als Nachweis über die Fortgeltung der deutschen Rechtsvorschriften bei Entsendung von Mitarbeitern in EU-/EWR-Mitgliedsstaaten oder der Schweiz.

Bisher war die Antragsstellung nach § 106 Abs. 1 SGB IV für Arbeitgeber freiwillig. Durch die Gesetzesänderung mit Wirkung zum 1. Januar 2019 ist die Antragsstellung nunmehr verpflichtend für Arbeitgeber.
