Piraterie-Abkommen droht übers Ziel hinauszuschießen

BITKOM: Grundlegende Rechtsprinzipien nicht opfern / Provider dürfen nicht zu Anschluss-Sperren gezwungen werden

Der Hightech-Verband BITKOM hat sich besorgt über den Stand der Verhandlungen zum internationalen Anti-Piraterie-Abkommen ACTA geäußert. "Es besteht die Gefahr, dass die Verhandlungspartner das Paket zu sehr beladen haben und sich daran verheben", sagte BITKOM-Präsidiumsmitglied Volker Smid. "Wir befürchten, dass vieles über einen Kamm geschoren wird und die Maßnahmen über das Ziel hinausschießen." ACTA steht für Anti-Counterfeiting Trade Agreement. Dies ist ein völkerrechtlich bindendes Abkommen, über das EU, USA, Kanada, Japan und weitere Länder seit Jahren verhandeln. Es geht derzeit in die letzte Verhandlungsphase und soll noch 2010 besiegelt werden.

"Wir brauchen dringend eine bessere internationale Bekämpfung von Produktpiraterie, gerade auch im IT-Bereich", erklärt Smid. Dabei sollte es um Geräte und Produkte, aber auch um Software und das Internet gehen. "Wir müssen dabei darauf achten, dass Verfolgungsmaßnahmen verhältnismäßig sind. Privatsphäre und Datenschutz, aber auch grundlegende Prinzipien unseres Rechtssystems dürfen dabei nicht geopfert werden."

Die in den Verhandlungen diskutierte Überprüfung der Speicher von MP3-Playern oder PCs bei Grenzkontrollen müsse tabu bleiben, fordert BITKOM. Auch dürften Anbieter von Internet-Zugängen nicht gezwungen werden, ihren Kunden beim Verdacht auf Piraterie den Anschluss zu kappen. "Provider zu Sheriffs und Vollzugsorganen zu machen, widerspricht unserem Rechtsverständnis", so Smid. "Die Strafverfolgung ist Aufgabe von Polizei und Justiz. Nur wenn offizielle Ermittlungen laufen, sollten Unternehmen zur Mitarbeit verpflichtet werden. In Deutschland haben wir dafür bereits geeignete Gesetze." Da ACTA völkerrechtlich bindend ist, könnten EU-Mitgliedsstaaten gezwungen sein, ihr nationales Recht anzupassen.
