„In den 25 Jahren, die wir nun mit anwenderspezifischen Programmen und Standardlösungen auf dem Markt sind, mussten wir zum ersten mal zu solch drastischen Maßnahmen greifen. In diesem speziellen und sehr dreisten Fall einer Rufschädigung, wie sie durch die Beklagte (Rechtsanwältin Vera Mai) erfolgte, haben wir uns für eine Unterlassungsklage entschieden und erfreulicherweise vor Gericht Recht bekommen,“ erläutert André Koppel, Geschäftsführer der André Koppel Software GmbH.
Vor dem Landgericht Berlin wurde der Beklagten am 11.12.2008 verboten, ihre rufschädigenden Äußerungen über die Insolvenzverwaltungssoftware INVEP, die sie im Rahmen eines Artikels in der Zeitschrift InsBüro veröffentlichte, sowie die Nachteile gegenüber einem Konkurrenzprodukt, zu verbreiten. Dies beinhaltet sämtliche Negativaussagen des Artikels, die die Beklagte, wie sich in dem Verfahren zeigte, tatsächlich nicht belegen konnte, deren Wahrheitsgehalt vom Kläger, der Andre Koppel Software GmbH dagegen en détail auf der Basis von Aufzeichnungen widerlegt werden konnte.
Bei Zuwiderhandlung droht Vera Mai ein Ordnungsgeld bis zu 250.000,00 € oder eine Ordnungshaft von bis zu sechs Monaten. Die Widerspruchsfrist ist abgelaufen, das Urteil ist jetzt rechtskräftig.
