Darauf hat der ACE Auto Club Europa am Freitag in Stuttgart hingewiesen. Zuvor hatten sich die Hamburger Finanzbehörde und der dortige Verkehrsverbund (HVV) auf Initiative des Clubs auf die uneingeschränkte Anwendung der Sachbezugsregelung für den Jobticket-Vertrieb verständigt. Danach darf der Zuschuss pro Monatskarte nicht höher als 44 Euro ausfallen. Dieser Betrag entspricht der vom Einkommenssteuergesetz (§ 8) gezogenen Grenze für steuerfreie Sachbezüge.
Für den ACE hat die Hamburger Praxis eine "bundesweit Beispiel gebende Bedeutung". Arbeitnehmer wie Arbeitgeber würden entlastet. Die geförderte Nutzung öffentlicher Verkehrsmittel sei angesichts hoher Kraftstoffpreise zudem ein wirksames Mittel für mehr wirtschaftliche Effizienz im Berufsverkehr.
"Bei Inanspruchnahme dieser Regelung entfällt für den Arbeitgeber die Entrichtung der Sozialversicherungsabgaben, für den Arbeitnehmer entfallen Lohnsteuer und Sozialversicherungsabgaben auf den gewährten Fahrgeldzuschuss", sagte ACE-Verkehrsexperte Manfred Maertzke. Damit sei auch die bislang strittige Frage geklärt, ob monatliche Jobtickets unter die so genannte 44-Euro-Regelung fallen. Finanzämter hätten dies in der Vergangenheit häufig unterschiedlich beurteilt.
