(iGZ) „Die Auswirkungen der bevorstehenden Zeitarbeitsreform werden für jeden dritten Zeitarbeitnehmer spürbar sein“, erklärt der Hauptgeschäftsführer des Interessenverbandes Deutscher Zeitarbeitsunternehmen (iGZ), Werner Stolz. Vorgesehen ist die Einführung eines gesetzlichen Anspruchs auf Gleichbezahlung nach neun Monaten sowie einer maximalen Überlassungsdauer von 18 Monaten. Aktuell dauern 40 Prozent der Zeitarbeitseinsätze länger als neun Monate und rund 20 Prozent länger als 18 Monate. „Zeitarbeitnehmer haben schon jetzt einen tariflichen Anspruch auf eine Lohnangleichung“, erklärt Stolz. In elf Branchen sei eine Lohnangleichung in fünf Stufen und binnen neun Monaten schon heute Realität. Bei zwei Dritteln aller Zeitarbeitseinsätzen kämen diese Branchenzuschläge aktuell zur Anwendung. Als „überflüssig“ bezeichnet Stolz auch die Einführung einer maximalen Überlassungsdauer: „Die Politik sollte sich langsam mal entscheiden, ob sie der Branche zu kurze oder zu lange Einsätze zum Vorwurf machen möchte. Wenn es einen gesetzlichen Anspruch auf eine vergleichbare Bezahlung nach neun Monaten gibt, macht ein erzwungenes Einsatzende nach 18 Monaten jedenfalls keinen Sinn mehr.“ Insgesamt seien aus Gründen der Praktikabilität jedenfalls drei wesentliche Änderungen am Gesetzesentwurf notwendig: „Der Gesetzgeber muss ‚Equal Pay‘ klar definieren, um keine Flut von Arbeitsgerichtsprozessen durch dieses Gesetz zu provozieren. Die im Gesetz bei Verstoß vorgesehenen Strafen müssen unter den Verhältnismäßigkeitsgrundsatz gefasst werden. Und tarifliche Abweichungen müssen nicht nur den Einsatzbranchen, sondern insbesondere der Zeitarbeit zugestanden werden, da es um die Regelung der Arbeitsbedingungen des Zeitarbeitnehmers geht“, so Stolz.
