Wissensvorsprünge sind wertvoll und spielen für den Erfolg eines Unternehmens eine entscheidende Rolle. Dabei kann es sich um vertrauliches betriebswirtschaftliches Wissen, spezifisches technisches Know-how oder andere Informationen handeln, mit denen sich Firmen einen Wettbewerbsvorteil sichern möchten. Wo Wissen ‚gestohlen‘ wird, ist der Schaden oft hoch und schwer zu reparieren: Das Bundesamt für Verfassungsschutz geht von 30 bis 60 Milliarden Euro Schaden aus, die die deutsche Industrie jährlich verkraften muss. Dabei handelt es sich nicht nur um ein abstraktes, gesamtwirtschaftliches Problem: Auch die betroffenen Unternehmen haben mit den finanziellen Folgen von Know-how-Diebstahl und Produktpiraterie zu kämpfen. „Viele wissen jedoch nicht, wo sie beim Schutz ansetzen müssen und welche Möglichkeiten es gibt, um sich rechtlich bestmöglich abzusichern“, sagt Erik Schäfer, Rechtsanwalt und Partner von Cohausz & Florack. „Neben technischem Geheimnisschutz sollten Vereinbarungen getroffen werden, die die Beteiligten dazu verpflichten, die vertraulichen Informationen geheim zu halten.“ Unternehmen, die auf diese Weise vorsorgen, stehen rechtliche Möglichkeiten offen für den Fall, dass ihr Wissen dennoch unbefugt nach außen gelangt.
Der IT-technische Schutz vertraulicher Informationen spielt gleichwohl eine wichtige Rolle: „Selbst vermeintlich sichere Daten können für Außenstehende unter Umständen einsehbar werden. Wer frühzeitig sinnvolle Strukturen zur Informationssicherheit in seinem Betrieb etabliert, kann vorbeugen und seine Informationen vor Verlust und Missbrauch schützen“, sagt Wolfgang Straßer, Geschäftsführer des IT-Sicherheitsdienstleisters @-yet.
